Room by Color (“Room by Color”, “we”, “us”, or “our”) is committed to protecting your privacy. We have prepared this Privacy Policy (“Privacy Policy”) to describe our practices regarding the personal information we collect from users on our website, located at www.roombycolor.com (the “Site”). In general, personal information you submit to us is used either to respond to requests that you make, aid us in serving you better, or market our services. 

 

Room by Color may update this Privacy Policy from time to time. Be advised to review the Privacy Policy periodically for any updates. You may request that we delete your personal information, but please note that when we delete any information, it will be deleted from the active database, but may remain in our archives. We may retain your information for fraud prevention or similar purposes. Updates will be effective immediately for users of the Site.

Information Collected from You. When you contact us via the Site, we will collect your name, email address, mobile phone number, project address, and any project information you choose to share with us in order to reply to you. If you provide us feedback or contact us via email, we will collect your name and email address, as well as any other content included in the email for our records and in order to send you a reply. When you participate in one of our surveys, we may collect additional profile information. In our subsequent correspondences with you, either via email or telephone, we may request and collect additional project information.

 

We reserve the right to take reasonable steps to verify your identity and request, including using the profile and project information to access publicly available databases, such as those available through municipal and state agencies.

 

We review each project for fitness with our services prior to accepting the project. We reserve the right to decline any project for any reason.

Marketing. We may periodically send you newsletters and emails that directly promote the use of our services. When you receive newsletters or promotional communications from us, you may indicate a preference to stop receiving further communications from us and you will have the opportunity to “opt-out” by following the unsubscribe instructions provided in the email you receive or by contacting us directly. Despite your indicated email preferences, we may send you service related communications, including notices of any updates to our Terms of Use or Privacy Policy.

Information Collected from Third-Party Companies.  We may receive information about you from other sources, including from Social Networking Sites ("SNS"), such as Facebook, Instagram, Pinterest, LinkedIn or Twitter (each an “SNS”). We may add this information to the information we have already collected from you.

We may post user feedback on the Services from time to time. If you make any comments on a SNS wall or forum associated with us, you should be aware that any information you submit there can be read, collected, or used by us or other users of these forums, and could be used to send you unsolicited messages. We are not responsible for the information you choose to submit in these forums.

You acknowledge and agree that you are solely responsible for your use of SNSs and that it is your responsibility to review the terms of use and privacy policy of the third-party provider of such SNSs. We will not be responsible or liable for: (i) the availability or accuracy of such SNSs; (ii) the content, products or services on or availability of such SNSs; or (iii) your use of any such SNSs.

Information Collected Automatically. When you use the Site, some information is automatically collected by us or by our website hosting service, Wix.com. For example, when you use the Site, your geographic location, how you use the Site, information about the type of device you use, your mobile network information, your Open Device Identification Number (“ODIN”), date/time stamps for your visit, your unique device identifier (“UDID”), and your browser type, operating system, Internet Protocol (IP) address, and domain name may be collected. This information may be used to help us deliver the most relevant information to you and administer and improve the Site. Log Files. As is true of most websites, we may gather certain information automatically and store it in log files. This information includes IP addresses, browser type, Internet service provider (“ISP”), referring/exit pages, operating system, date/time stamp, and clickstream data. We use this information to maintain and improve the performance of the Site.

Cookies. Like many online services, we may use cookies to collect information. “Cookies” are small pieces of information that a website sends to your computer’s hard drive while you are viewing the website. We and some third parties may use both session Cookies (which expire once you close your web browser) and persistent Cookies (which stay on your computer until you delete them) to provide you with a more personal and interactive experience on our Site and to market our services or other products.

Analytics Companies. We may work with a number of third-party analytics companies that collect information anonymously and report website trends without identifying individual visitors. These services allow us to view a variety of reports about how visitors interact with the Site so we can improve our website and understand how people find and navigate it. Currently, we work with Wix.com. This is not intended to be a comprehensive list and we may stop working with these companies and work with others without notice. Third-Party Websites. Our Site may contain links to third-party websites. When you click on a link to any other website or location, you will leave our Site and go to another site, and another entity may collect personal information or anonymous data from you. Please be aware that the terms of this Privacy Policy do not apply to these outside websites. We have no control over, do not review, and are not responsible for, these outside websites or their content. We encourage you to read the privacy policies of every website you visit. The links to third-party websites or locations are for your convenience and do not signify our endorsement of such third-parties or their products, content or websites.

Disclosure of Your Personal Information. We disclose your personal information as described below and elsewhere in this Privacy Policy.

Third Parties Designated by You. When you contact us, the personal information you provide may be shared with the third parties that you authorize to receive such information. If you disclose information to others, or authorize us to do the same, the use and disclosure restrictions contained in this Privacy Policy will not apply to any third party. We do not control the privacy policies of third parties, and you are subject to the privacy policies of those third parties where applicable.

Third-Party Service Providers. We may share your personal information with third party service providers to: provide you with our services; facilitate your purchase(s) from third party partners; provide technical support; market our services; and/or to provide other services to Room by Color.

Corporate Restructuring. We may share some or all of your personal information in connection with or during negotiation of any merger, financing, acquisition or dissolution transaction or proceeding involving sale, transfer, divestiture, or disclosure of all or a portion of our business or assets. In the event of insolvency, bankruptcy, or receivership, personal information may also be transferred as a business asset. If another company acquires our company, business, or assets, that company will possess the personal information collected by us and will assume the rights and obligations regarding your personal information as described in this Privacy Policy.

Necessary Disclosure. We may disclose your personal information if we believe in good faith that such disclosure is necessary: (i) in connection with any legal investigation; (ii) to comply with relevant laws or to respond to subpoenas or warrants served on Room by Color; (iii) to protect or defend the rights or property of Room by Color or our users; and/or (iv) to investigate or assist in preventing any violation or potential violation of the law, this Privacy Policy, or our Terms of Use.
